These Terms constitute a legally binding agreement between you and Wholly Water Farms ("we," "us," or "our"), a Florida-based urban farm.

4. Farm Store Purchases

All products available through our farm store are subject to availability. Prices for products are listed on the Site and may change without prior notice. We reserve the right to modify pricing at any time.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity. If we cancel an order after payment has been processed, we will issue a full refund.

Merchandise orders are fulfilled and shipped through our third-party print-on-demand fulfillment partner. Shipping times, methods, and costs are determined by the fulfillment partner and will be communicated at checkout. Wholly Water Farms is not responsible for delays caused by the fulfillment partner or shipping carriers.

5. Product Descriptions

We strive to ensure that product descriptions, images, and other information on our Site are accurate and up to date. However, we do not warrant that all product descriptions, pricing, images, or other content is error-free, complete, or current.

Product colors may vary slightly from what appears on your screen due to differences in monitor settings, lighting conditions, and manufacturing processes. Photographs of microgreens and mushrooms represent typical harvests and may differ from the exact product you receive due to the natural variability of living produce.

6. Newsletter and Communications

Our newsletter and promotional communications are strictly opt-in. We will only send you marketing emails if you have explicitly subscribed. You may unsubscribe at any time by clicking the unsubscribe link included in every email or by contacting us at hello@whollywaterfarms.com.

Transactional emails related to your orders (such as order confirmations and shipping notifications) are not considered marketing communications and will be sent regardless of your newsletter subscription status.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO WHOLLY WATER FARMS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
